On September 28, 2016, the parties filed a joint stipulation dismissing the sole defendant,

20

Quanta Specialty Lines Insurance Company, from this action with prejudice and with each party

21

to bear its own costs and attorneys’ fees. (Doc. No. 32.) In light of the parties’ stipulation, this

22

action has been terminated, see Fed. R. Civ. P. 41(a)(1)(A)(ii); Wilson v. City of San Jose, 111

23

F.3d 688, 692 (9th Cir. 1997), and has been dismissed with prejudice and without an award of

24

attorneys’ fees and costs to either party. Accordingly, the Clerk of the Court is directed to close

25

the case.
