The Court has received and reviewed the parties’ stipulation for amendment of the
21 Complaint. The Court accepts the stipulation and orders that the Third and Fourth Claims for
22 Relief are dismissed, with prejudice. Plaintiff may file an amended complaint that shall restate the
23 First and Second Claims for Relief. See 42 U.S.C. § 1983.

The hearing previously set for March 25, 2015, is hereby vacated.
