(Doc. 21) He relies upon Fed. R. Civ. P. Rule 41 which provides, “the plaintiff 18 may dismiss an action without a court order by filing: (i) a notice of dismissal before the opposing 19 party serves either an answer or a motion for summary judgment; . . .” Fed. R. Civ. P. 41(a)(1)(A). 20 Such a notice is effective as a dismissal without an order of the court. Fed. R. Civ. Pro. 41(a)(1)(ii); 21 Wilson v. City of San Jose, 111 F.3d 688, 692 (9th Cir. 1997). However, because this defendant has 22 not been terminated on the docket, the Court DIRECTS the Clerk of Court to terminate this action as 23 to Defendant, Allison Transmission only. 24 25 26 27 28 IT IS SO ORDERED.
