Defendant removed the action to the Eastern 20 District of California on April 3, 2015. On April 7, 2015, Defendant filed a motion to dismiss 21 and motion to strike. The motions were referred to the undersigned and a hearing is set for May 22 13, 2015. 23 On April 20, 2015, Plaintiff filed a motion to remand this action back to the state court. 24 The motion to remand was referred to the undersigned by District Judge Anthony Ishii. 25 Plaintiff’s motion to remand is based on a lack of jurisdiction. Since Plaintiff is challenging this 26 Court’s jurisdiction, the motion to dismiss shall be stayed pending resolution of the motion to 27 remand. 28 /// 1 1 Accordingly, IT IS HEREBY ORDERED that: 2 1.
