Plaintiff Michael Purtue is appearing pro se and in forma pauperis in this civil rights action
pursuant to 42 U.S.C. § 1983.

On December 21, 2016, Plaintiff filed a motion for leave to file an amended complaint, and

submitted a proposed third amended complaint which was lodged by the Court. (ECF Nos. 35, 36.)

Defendants have not filed an opposition or statement of non-opposition to Plaintiff’s motion. Local

19

Rule 230(l). Accordingly, within twenty-one (21) days from the date of service of this order,

20

Defendants shall file an opposition or statement of non-opposition to Plaintiff’s motion for leave to

21

amend the complaint.
