The parties hereby stipulate by counsel, with the Court’s approval as indicated by

issuance of the attached Order, that Defendant shall have a first extension of time of 30 days to

respond to Plaintiff’s Opening Brief up to and including April 29, 2016. The response is
24
currently due March 30, 2016. This extension is being sought because counsel for the Defendant
25
needed to leave town unexpectedly for a funeral.
The parties also stipulate that the scheduling order shall be modified accordingly.
