Plaintiff,
Case No. 1:15-cv-00916---GSA
ORDER GRANTING APPLICATION TO
PROCEED IN FORMA PAUPERIS
v.
CITY OF TULARE, et al.,
(ECF Nos. 3, 5)
Defendants.
16
17
On June 17, 2015, Plaintiff Bruce Creamer (“Plaintiff”) filed a Complaint. (ECF Nos. 1,
18
2). On that same date, Plaintiff filed an application to proceed in forma pauperis (“IFP”) in lieu of
19
paying the filing fee to commence an action in this Court. (ECF No. 3). Because the application
20
was incomplete, the Court issued an order directing Plaintiff to complete and re-submit the
21
request to proceed IFP. (ECF No. 4). Plaintiff has done so and has now provided the requested
22
information. (ECF No. 5). Based on the newly submitted information, Plaintiff has made the
23
required showing pursuant to 28 U.S.C. § 1915(a). Accordingly, the request to proceed in forma
24
25
pauperis is GRANTED.
26
As to the status of his complaint, Plaintiff is advised that pursuant to 28 U.S.C.
27
§ 1915(e)(2), the court must conduct an initial review of every pro se complaint to determine
28
1
1
whether it is legally sufficient under the applicable pleading standards. The court must dismiss a
2
complaint, or portion thereof, if the court determines that the complaint is legally frivolous or
3
malicious, fails to state a claim upon which relief may be granted, or seeks monetary relief from a
4
defendant who is immune from such relief. 28 U.S.C. § 1915(e)(2). If the court determines that
5
6
the complaint fails to state a claim, leave to amend may be granted to the extent that the
7
deficiencies in the complaint can be cured by amendment. Plaintiff’s Complaint will be screened
8
in due course.
9
10
11
If appropriate after the case has been screened, the Clerk of Court will provide Plaintiff
with the requisite forms and instructions to request the assistance of the United States Marshal in
serving Defendants pursuant to Federal Rule of Civil Procedure 4.
12
13
14
15
IT IS SO ORDERED.
