This action was filed on June 18, 2015. (ECF No. 1.) On August 12, 2015, Defendant
23 filed an answer and counter-claim. (ECF no. 9.) On January 9, 2017, the parties filed a
24 stipulation dismissing this action with prejudice with each party to bear its own costs and fees.
25 In light of the stipulation of the parties, this action has been terminated. Fed. R. Civ. P.
26 41(a)(1)(ii); Wilson v. City of San Jose, 111 F.3d 688, 692 (9th Cir. 1997), and has been
27 dismissed with prejudice and without an award of costs or attorneys’ fees.
