ORDER
Pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure, Plaintiff Carmela
3 Mora and Defendant Cal West Ag Services, Inc., through their respective counsel of record, have
4 stipulated to the dismissal of all causes of action as to Defendant Cal West Ag Services, Inc. with
5 prejudice in this action. Plaintiff and Defendant Cal West Ag Services, Inc. further stipulate that
6 each party is to bear its own costs and attorneys’ fees.

The stipulation was signed by counsel for Plaintiff Mora and counsel for Defendant Cal
8 West Ag Services, Inc. Defendants Jon and Eric Marthedal did not sign the stipulation. In order
9 to have effect, Rule 41(a)(1)(A)(ii) requires a “stipulation of dismissal signed by all parties who
10 have appeared.” Fed. R. Civ. P. 41(a)(1)(A)(ii).

Accordingly, the parties must resubmit a stipulation signed by all parties who have
12 appeared.
