On May 10, 2017, the Court issued Findings and Recommendation to deny the petition for

18

writ of habeas corpus. On June 12, 2017, Petitioner filed objections to the Findings and

19

Recommendation along with a request for certificate of appealability. Pursuant to the Court’s

20

general practice and in keeping with Ninth Circuit directives, the Clerk’s Office construed the

21

request as a notice of appeal and processed the appeal to the Ninth Circuit Court of Appeal. The

22

Findings and Recommendation will be submitted to the District Judge once the Ninth Circuit

23

remands the matter back to the District Court.
