This action was filed on January 20, 2016. (ECF No. 1.) On September 15, 2017,

18 Plaintiffs filed a motion for preliminary approval of class action settlement with Defendant Pier 1
19 Imports (U.S.), Inc. (ECF No. 42.) On September 20, 2017, the parties filed a joint stipulation
20 dismissing only Defendant Pier 1 Imports, Inc. with prejudice pursuant to Rule 41(a)(1)(A)(ii) of
21 the Federal Rules of Civil Procedure. (ECF No. 43.)

In light of the stipulation of the parties, Defendant Pier 1 Imports, Inc. has been

23 terminated, Fed. R. Civ. P. 41(a)(1)(A)(ii); Wilson v. City of San Jose, 111 F.3d 688, 692 (9th
24 Cir. 1997), and has been dismissed without an award of costs or attorneys’ fees.

Accordingly, the Clerk of the Court is DIRECTED to terminate Defendant Pier 1
