IT IS HEREBY STIPULATED by and between plaintiff NAVTEJ SINGH (“Plaintiff”)

and defendants U.S. COMMERCIAL FREIGHT, INC., YURIY STEFANYSHYN and PAVEL
23
KLIMOVICH (“Defendants”), through their designated counsel, that plaintiff will undergo a
24
physical examination pursuant to Rule 35 of the Federal Rules of Civil Procedure. Said
25
examination shall take place on or about May 22, 2017 at 2:00 p.m. and will be conducted by
26
Joseph Capell, M.D. at 5550 N. Palm Avenue, #101, Fresno, California 93701, Telephone: (559)
27
435-0161.

MEDICAL EXAMINATION

This examination will be conducted for the purpose of determining the nature and extent
2
of plaintiff’s physical injuries and the relationship thereof to the accident which is the subject of
3
this litigation, and will consist of all necessary and customary activities required to make such a
4
determination, including but not limited to medical history, history of accident in question, and
5
physical examination and evaluation. Photographs of plaintiff’s injuries may be taken for use at
6
trial.

Per Dr. Capell’s cancellation policy, any cancellations must be made within 3 business
days of the scheduled examination. If this examination is not cancelled pursuant to the doctor’s
9
guidelines, plaintiff will be responsible for the associated cancellation fee of $960.

IT IS FURTHER STIPULATED that per Rule 26(a)(2)(B) of the Federal Rules of Civil

Procedure, Dr. Capell’s medical examination report shall be provided to all parties within 30 days

of the medical examination.
