Myers is a state prisoner proceeding pro se and in forma pauperis pursuant to 12 13 ) ) ) ) ) ) ) ) ) 42 U.S.C. § 1983. 14 On June 14, 2017, the parties submitted a stipulation of voluntary dismissal, with prejudice and 15 with each party to bear its own litigation costs and attorney’s fees. Therefore, this action has been 16 terminated, and dismissed with prejudice and without an award of costs or attorneys’ fees. Fed. R. Civ. 17 P. 41(a)(1)(A)(ii); Wilson v. City of San Jose, 111 F.3d 688, 692 (9th Cir. 1997). 18 Accordingly, the Clerk of the Court is HEREBY ORDERED to terminate all pending motions 19 and deadlines, close the file in this case, and adjust the docket to reflect voluntary dismissal of this 20 action pursuant to Federal Rule of Civil Procedure Rule 41(a). 21 22 IT IS SO ORDERED. 23 Dated: 24 25 26 27 28 June 15, 2017 UNITED STATES MAGISTRATE JUDGE
