TREBLE, LLC., et al., 15 Defendants. ) ) ) ) ) ) ) ) Case No.: 1:16-cv-00692 LJO JLT ORDER CLOSING THE CASE (Doc. 29) 16 17 On May 10, 2017, the parties filed as stipulation to dismiss this action with prejudice, with 18 each party to bear their own attorney fees and costs. (Doc. 29) The stipulation relies on Fed. R. 19 Civ.P. 41(a)(1) which provides, “the plaintiff may dismiss an action without a court order by 20 filing: . . . a stipulation of dismissal signed by all parties who have appeared.”. . .” Fed. R. Civ. P. 21 41(a). Once such a notice has been filed, an order of the Court is not required to make the 22 dismissal effective. Fed. R. Civ. P. 41(a)(1)(ii); Wilson v. City of San Jose, 111 F.3d 688, 692 (9th 23 Cir. 1997). Thus, the Clerk of Court is DIRECTED to close this action in light of the stipulation 24 signed pursuant to Rule 41(a). 25 26 27 28 IT IS SO ORDERED. Dated: May 11, 2017 /s/ Jennifer L.
