Case No.: 1:16-cv-0699- JLT
ORDER TO SHOW CAUSE WHY SANCTIONS
SHOULD NOT BE IMPOSED FOR THE
PARTIES’ FAILURE TO COMPLY WITH THE
COURT’S ORDER
16
17
On June 30, 2016, the Court granted the motion to stay the action pending resolution of
18
criminal proceedings. (Doc. 14) The parties were ordered to file joint status reports every 60 days to
19
keep the Court informed as to the status of the matter. (Id. at 2) The parties last filed a joint report on
20
July 13, 2017. (Doc. 21) As a result, the parties were to have filed another status report no later than
21
September 11, 2017. (See Doc. 8 at 1) To date, no joint status report has been filed.
22
The Local Rules, corresponding with Fed. R. Civ. P. 11, provide: “Failure of counsel or of a
23
party to comply with . . . any order of the Court may be grounds for the imposition by the Court of any
24
and all sanctions . . . within the inherent power of the Court.” Local Rule 110. “District courts have
25
inherent power to control their dockets,” and in exercising that power, a court may impose sanctions
26
including dismissal of an action. Thompson v. Housing Authority of Los Angeles, 782 F.2d 829, 831
27
(9th Cir. 1986). A court may dismiss an action with prejudice, based on a party’s failure to prosecute
28
an action or failure to obey a court order, or failure to comply with local rules. See, e.g. Ferdik v.
1
1
Bonzelet, 963 F.2d 1258, 1260-61 (9th Cir. 1992) (sanctions for failure to comply with an order);
2
Malone v. U.S. Postal Service, 833 F.2d 128, 130 (9th Cir. 1987) (imposing sanctions for failure to
3
comply with a court order).
4
5
Accordingly, the parties are ORDERED to show cause within fourteen days why sanctions
should not be imposed for failure to comply with the Court’s order or to file a joint status report.
