IT IS HEREBY STIPULATED, by and between the parties, through their respective

counsel of record, that the time for Defendant to respond to Plaintiff’s Opening Brief be

extended from February 22, 2017, to March 24, 2017. This is Defendant’s first request for an

24

extension of time to respond to Plaintiff’s motion. Defendant respectfully requests this

25

additional time because the undersigned accepted a position outside government and the office is

26

in the process of reassigning my workload to attorneys in the office.

The parties further stipulate that the Court’s Scheduling Order shall be modified
accordingly.
