D. DESHA, et al., 15 (ECF Nos. 8, 12) Defendants. 16 17 18 19 20 Plaintiff is a state prisoner proceeding pro se in this civil rights action brought 21 pursuant to 42 U.S.C. § 1983. The action was removed from the Madera County 22 Superior Court on September 12, 2016, and was referred to a United States Magistrate 23 Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302 of the United States 24 District Court for the Eastern District of California. 25 On December 8, 2016, the Magistrate Judge issued findings and 26 recommendations to deny Plaintiff’s motion for remand. (ECF No. 12.) No objections 27 were filed. 28 1 In accordance with the provisions of 28 U.S.C. § 636(b)(1)(C), the Court has 2 conducted a de novo review of this case. Having carefully reviewed the entire file, the 3 Court finds the findings and recommendations to be supported by the record and by 4 proper analysis. 5 Based on the foregoing, it is HEREBY ORDERED that: 6 1. 7 The Court adopts the findings and recommendations, filed December 8, 2016 (ECF No. 12), in full; 8 2. Plaintiff’s motion for remand (ECF No. 8) is DENIED; and 9 3. This matter is referred back to the Magistrate Judge for further 10 proceedings. 11 12 13 IT IS SO ORDERED.
