Plaintiff filed a motion to compel responses to Plaintiff’s request for production of

15 documents and interrogatories on September 13, 2017. On September 27, 2017, the parties filed
16 a joint statement of discovery dispute. Plaintiff filed a motion to withdraw the motion to compel
17 without prejudice on October 3, 2017.

Accordingly, IT IS HEREBY ORDERED that:

The hearing set for October 4, 2017 is VACATED and the parties are not required
to appear at that time; and
