IT IS HEREBY STIPULATED, by and between Darrin Ronald Beagles (Plaintiff) and Nancy

A. Berryhill, Acting Commissioner of Social Security (Defendant), by and through their respective

counsel of record, that Defendant shall have an extension of time of thirty-five (35) days to file her
21
Opposition to Plaintiff’s Opening Brief. The current due date is September 20, 2017. The new date
22
will be October 25, 2017. An extension of time is needed because the attorney responsible for briefing
23
recently returned from medical leave after unexpected surgery. This request is made in good faith with
24
no intention to unduly delay the proceedings.

This is the second extension of time request by Defendant in the above-captioned matter.
Defendant is aware that more than one extension is disfavored and apologizes both to Plaintiff and the

Court for the inconvenience. The parties further stipulate that the Court’s Scheduling Order shall be
modified accordingly.
