(ECF No. 60) 16 17 Plaintiff Sandra Huizar (“Plaintiff”) and Defendant Experian Information Solutions, Inc. 18 (“Experian”) (collectively, the “Parties”), by and through their counsel of record, hereby 19 stipulate and agree that Plaintiff’s claims against Experian should be dismissed, with prejudice, 20 21 with Plaintiff and Experian to each bear their own costs and attorneys’ fees. The Parties agree that this Court can proceed to dismiss Defendant Experian, with prejudice, from this action. (ECF No. 60). Thus, the claims against 4 Defendant Experian Information Solutions, Inc. have been terminated, see Fed. R. Civ. P. 5 41(a)(1)(A)(ii); Wilson v. City of San Jose, 111 F.3d 688, 692 (9th Cir. 1997), and dismissed 6 with prejudice. Concha v. London, 62 F.3d 1493, 1506 (9th Cir. 1995) (“Even if the defendant 7 has filed a motion to dismiss, the plaintiff may terminate his action voluntarily by filing a notice 8 of dismissal under Rule 41(a)(1).”). 9 Accordingly, the Clerk of the Court is DIRECTED to terminate Defendant Experian 10 Information Solutions, Inc. on the docket. Plaintiff Sandra Huizar and Defendant Experian 11 Information Solutions, Inc. shall each bear their own costs and attorneys’ fees. 12 13 14 15 IT IS SO ORDERED.
