On March 2, 2018, the parties filed an 19 application to shorten time for hearing on the motion to dismiss which was denied as moot by 20 District Judge Anthony W. Ishii on March 9, 2018 when the hearing was vacated and the matter 21 was taken under submission. 22 In the application to shorten time, the parties also requested that the mandatory 23 scheduling conference be advanced from May 29, 2018 to April 2, 2018. However, the Court 24 declines to hold the mandatory scheduling conference until decision on the motion to dismiss and 25 an answer is filed in the action at which time the Court deems that the matter is ripe for 26 scheduling.
