On January 27, 2017, Plaintiff filed this action in Tulare County Superior Court. (ECF
14
15 No. 1-1 at 2-5.) On June 6, 2017, Defendant removed the action to the Eastern District of
16 California. (ECF No. 1.) On January 31, 2018, the parties filed a stipulation to dismiss the
17 action with prejudice with each party to bear its own costs and fees. (ECF No. 26.) In light of
18 the stipulation of the parties, this action has been terminated, Fed. R. Civ. P. 41(a)(1)(A)(ii);
19 Wilson v. City of San Jose, 111 F.3d 688, 692 (9th Cir. 1997), and has been dismissed with
20 prejudice and without an award of costs or attorneys’ fees.
Accordingly, the Clerk of the Court is HEREBY ORDERED to CLOSE the file in this
21
22 case and adjust the docket to reflect voluntary dismissal of this action pursuant to Rule 41(a).
