On March 14, 2019, the Court denied Petitioner’s motion 19 to dismiss the incident report and denied the petition for writ of habeas corpus on the merits. 20 (ECF No. 44). Petitioner has appealed the judgment. (ECF Nos. 46, 47). On March 14, 2019,2 the instant motion to dismiss Petitioner’s incident report was filed. 21 22 (ECF No. 43). Therein, Petitioner raises the same arguments previously raised in his two prior 23 motions to dismiss the incident report. (ECF Nos. 23, 34).
