Foster, B. Morse, P. Perez, and R. Ruvalcaba filed a 18 stipulation to dismiss the action, noting “Plaintiff hereby voluntarily dismisses this lawsuit pursuant to 19 Federal Rule of Civil Procedure 41(a)(1)(A)(ii).” (Doc. 68 at 1) Pursuant to Rule 41, “the plaintiff 20 may dismiss an action without a court order by filing . . . a stipulation of dismissal signed by all parties 21 who have appeared.” Fed.R.Civ.P. 41(a)(1)(A)(ii). 22 Because all remaining parties signed the stipulation, it “automatically terminate[d] the action.” 23 Wilson v. City of San Jose, 111 F.3d 688, 692 (9th Cir. 1997); Fed.R.Civ.P. 41(a)(1)(A)(ii).
