AETNA LIFE INSURANCE COMPANY, et al., (ECF No. 9) 15 Defendants. 16 17 18 Plaintiff Aaron Grubb filed this action on April 12, 2018, against Defendants Aetna Life 19 Insurance Company and Trustee of the Aviation Health Association Insurance Trust for the 20 Benefit of Members of the NetJets Association of Shared Aircraft Pilots pursuant to the 21 Employee Retirement Income Security Act (ERISA), 29 U.S.C. ยง 1101, et seq. (ECF No. 1.) 22 On May 7, 2018, a stipulation was filed dismissing without prejudice Defendant Trustee of the 23 Aviation Health . Association Insurance Trust for the Benefit of Members of the NetJets 24 Association of Shared Aircraft Pilots. 25 Rule 41(a) of the Federal Rules of Civil Procedure allows a party to dismiss some or all 26 of the defendants in an action through a Rule 41(a) notice. Wilson v. City of San Jose, 111 F.3d 27 688, 692 (9th Cir. 1997).
