CAUSE IN WRITING WHY SANCTIONS
SHOULD NOT ISSUE FOR FAILURE TO FILE
DISPOSITIONAL DOCUMENTS BY COURT
ORDERED DEADLINE
DEADLINE: JANUARY 13, 2025
16
17
18
On October 2, 2024, Defendants filed a notice of settlement of this action. (ECF No. 32.)
19
On December 4, 2024, the Court issued an order setting the deadline to file dispositional
20
documents by January 3, 2025. (ECF No. 35.) The deadline to file dispositional documents has
21
now expired, and the parties have failed to file such documents nor requested an extension of time
22
from the Court.
23
Local Rule 110 provides that “[f]ailure of counsel or of a party to comply with these Rules
24
or with any order of the Court may be grounds for imposition by the Court of any and all
25
sanctions . . . within the inherent power of the Court.” The Court has the inherent power to
26
control its docket and may, in the exercise of that power, impose sanctions where appropriate,
27
including dismissal of the action. Bautista v. Los Angeles Cnty., 216 F.3d 837, 841 (9th Cir.
28
2000). The Court shall require the parties to show cause why sanctions should not issue for the
1
1
failure to file dispositional documents in compliance with the Court’s order issued December 4,
2
2024.
3
Accordingly, IT IS HEREBY ORDERED that:
4
1.
The parties shall show cause in writing no later than January 13, 2025, why
5
sanctions should not issue for the failure to file dispositional documents by the
6
deadline required by the December 4, 2024, order (ECF No. 35). The parties are
7
advised that filing dispositional documents without also filing documents
8
showing cause in writing why sanctions should not issue does not constitute
9
compliance with this order; and
10
2.
Failure to comply with this order will result in the issuance of sanctions.
11
12
13
IT IS SO ORDERED.
