Petitioner, a state prisoner proceeding with appointed counsel, brings this petition

for a writ of habeas corpus pursuant to 28 U.S.C. § 2254.
On June 9, 2021, Petitioner filed a report on the status of state court proceedings.

See ECF No. 151. Notably, Petitioner advises this Court that, pursuant to the stipulation of the
21
parties, his death sentence has been vacated and that Petitioner has been resentenced to life
22
without the possibility of parole. See id. at 2. In light of Petitioner’s resentencing in state court,
23
Petitioner shall show cause in writing within 30 days of the date of this order why the instant
24
federal death penalty action should not be dismissed without prejudice to Petitioner’s right to
