Pending before the court is Defendant's motion for summary judgment (Doc. 275). Summary judgment is appropriate when it is demonstrated that there exists "no genuine issue as to any material fact and that the moving party is entitled to a judgment as a matter of law." Fed. R. Civ. P. 56(c). Defendant's motion was filed prior the entry of fact establishing sanctions for Defendant's failure to appear for her deposition (Docs. 315, 320). The facts establishing Defendant's liability have now been established. As such, summary judgment cannot be entered in Defendant's favor, and her motion should be denied.
