The matter was referred to a United States Magistrate Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local General Order No. 262. On November 13, 2008, the magistrate judge filed findings and recommendations herein which were served on plaintiff and which contained notice to plaintiff that any objections to the findings and recommendations were to be filed within twenty days. The findings and recommendations filed November 13, 2008, are adopted in full; and 2. Defendant Marquard's motion for summary judgment, filed July 21, 2008 (Docket #31), and defendant Penner's motion for summary judgment, filed July 22, 2008 (Docket #32), are granted, and this case is hereby closed.
