Judgment was entered on February 4, 2008, and plaintiff appealed. On December 14, 2009, the Ninth Circuit Court of Appeals issued an unpublished memorandum disposition affirming in part, vacating in part, and remanding for further proceedings. The court affirmed the grant of summary judgment as to plaintiff's Eighth Amendment claims regarding his knee condition and need for pain management. The court, however, vacated the grant of summary judgment as to plaintiff's Eighth Amendment claims related to gastroesophageal disease and dumping syndrome and remanded for further proceedings on these two claims.
