ORDER signed by Magistrate Judge Gregory G. Hollows on 12/21/09 ordering plaintiff must show good cause within 21 days why the unserved defendant Malfi should not be dismissed from this action. Plaintiff's first motion to compel further respons es/production to requests for production filed on 03/13/09 35 is granted in part and denied in part (See order for further details). Plaintiff's second motion to compel further responses to the first set of his interrogatories filed on 03/20/0 9 36 is granted in part and denied in part (See order for further details). In addition, to the extent that defendants have withheld any information based on the qualified official information privilege with regard to the discovery requests at issu e, which privilege was invoked without compliance with the procedural requisites, and in which any objection invoked on the basis is therefore waived, defendants must supplement all responses to include any information withheld on that basis within 1 4 days. All supplemental amended discovery responses must be served upon plaintiff, within 14 days of the date of this order, and proof of service thereof must be filed in this court with the same deadline. Plaintiff's motion for leave to file a second amended complaint filed on 04/03/09 40 is denied. Plaintiff's motion for leave to propound additional discovery requests, filed on 04/09/09 41 is denied.(Plummer, M)
