The parties, by and through their undersigned counsel of record, hereby stipulate and

request leave to file the Second Corrected Second Amended Complaint for Damages in Violation

of Civil Rights Pursuant to 42 U.S.C. § 1983, which is attached hereto as Exhibit A.

The parties are scheduled to participate in a VDRP session, to be conducted as a

5

settlement conference, on August 24, 2011 and need to serve one another as well as mediator

6

Mark A. Wasser with a written statement no later than August 17, 2011. To this end Plaintiffs

7

need to file the Second Corrected Second Amended Complaint to insure the parties will focus on

8

the relevant issues framed within. The parties have met and conferred regarding this matter.

Accordingly, the parties hereby stipulate and agree to the filing of the attached Second
Corrected Second Amended Complaint.
