On February 2, 2010, the United States Magistrate Judge formerly assigned to this case entered an order on various motions that were pending in this case. On February 18, 2010, petitioner filed a motion for reconsideration of the magistrate judge's February 2, 2010 order to the extent it denied petitioner's motion for discovery, in which he sought leave to conduct discovery in this habeas corpus case. Pursuant to E.D. Local Rule 303(f), a magistrate judge's orders shall be upheld unless "clearly erroneous or contrary to law."
