The court had previously directed the U.S. Marshal to serve defendant Chesser by Order, filed on March 5, 2010, directing the Marshal to notify the defendant of the commencement of this action and to request a waiver of service of summons in accordance with Fed. R Civ. P. 4(d) and 28 U.S.C. § 566(c) within ten days. An executed summons was filed on June 18, 2010, along with a request by the U.S. Marshal for reimbursement of costs for personal service of the defendant. Defendant Chesser filed an answer on July 9, 2010, but has filed no objection to the request by the U.S. Marshal.
