MCGUIRE, et al., Defendants. / On June 24, 2009, the court denied plaintiff's June 10, 2009 motion for reconsideration as untimely. Plaintiff points out to the court that the motion was timely considering occurrence of the Memorial Day holiday on May 25, 2009. Therefore, the court will vacate its June 24 order. However, the motion for reconsideration will still be denied. Pursuant to E.D. Local Rule 72-303(f), a magistrate judge's orders shall be upheld unless "clearly erroneous or contrary to law."
