1 2 3 4 5 6 7 8 9 10 11 12 13 14 Plaintiff Michael Aaron Jayne is a prisoner proceeding pro se pursuant to 42 U.S.C. § 1983 15 and has been granted leave to proceed in forma pauperis pursuant to 28 U.S.C. § 1915. Pursuant 16 to 28 U.S.C. § 1915(b)(1), Jayne is obligated to pay the statutory filing fee of $350.00 for this 17 a c tio n . An initial partial filing fee will not be assessed (due to the negative balance in 18 J a yn e 's account). Jayne is required to make monthly payments in the amount of twenty percent 19 of the preceding month's income credited to his trust account. 28 U.S.C. § 1915(b)(2). The 20 California Department of Corrections is obligated to send to the Clerk of the Court payments from 21 Jayne's account each time the amount in the account exceeds $10.00, until the statutory filing fee 22 is paid in full.
