TOM BOSENKO, et al., ORDER DIRECTING THE FILING OF A JOINT PRETRIAL STATEMENT AND CONFIRMING DATES FOR FINAL PRETRIAL CONFERENCE AND TRIAL Defendants. 16 17 Counsel are cautioned that counsel appearing for the final pretrial conference will in fact 18 try the matter. Counsel for all parties are to be fully prepared for trial at the time of the final 19 pretrial conference, with no matters remaining to be accomplished except production of witnesses 20 for oral testimony. Counsel are referred to Local Rules 281 and 282 relating to pretrial statements 21 and conferences. A FAILURE TO COMPLY WITH LOCAL RULES 281 AND 282 WILL BE 22 GROUNDS FOR SANCTIONS. 23 The parties shall file a joint pretrial statement not later than twenty-one days prior to the 24 pretrial conference. The joint pretrial statement shall conform to the requirements of Local Rule 25 281(b). Where the parties are unable to agree as to what factual issues are properly before the 26 court for trial, they should nevertheless list in the section on “DISPUTED FACTUAL ISSUES” 27 all issues asserted by any of the parties and explain by parenthetical the controversy concerning 28 each issue. The parties should keep in mind that, in general, each fact should relate or correspond 1 1 to an element of the relevant cause of action. The parties should also keep in mind that the 2 purpose of listing the disputed factual issues is to apprise the court and all parties about the 3 precise issues that will be litigated at trial. The court is not interested in a listing of all 4 evidentiary facts underlying the issues that are in dispute. 5 Pursuant to Local Rule 281(b), the parties are required to provide in their pretrial 6 statement a list of witnesses and exhibits that they propose to proffer at trial, no matter for what 7 purpose. These lists shall not be contained in the pretrial statement itself, but shall be attached as 8 separate documents to be used as addenda to the final pretrial order. Plaintiff’s exhibits shall be 9 listed numerically; defendant’s exhibits shall be listed alphabetically. 10 Counsel are reminded that, pursuant to Federal Rule of Civil Procedure 16, it will be their 11 duty at the pretrial conference to aid the court in (a) formulation and simplification of issues and 12 the elimination of meritless claims or defenses; (b) settling of facts which should be properly 13 admitted; and (c) avoidance of unnecessary proof and cumulative evidence. The parties must 14 prepare their joint pretrial statement, and participate in good faith at the pretrial conference, with 15 these aims in mind. A FAILURE TO DO SO MAY RESULT IN THE IMPOSITION OF 16 SANCTIONS which may include monetary sanctions, orders precluding proof, eliminations of 17 claims or defenses, or such other sanctions as the court deems appropriate. 18 19 Further, good cause appearing and for the reasons stated on the record, IT IS HEREBY ORDERED that: 20 1. The parties shall file a joint pretrial statement no later than August 10, 2016. 21 2. Pretrial conference (as described in Local Rule 282) is set for Wednesday, August 31, 22 2016 at 10:00 a.m. before the undersigned in Courtroom No. 8, 13th Floor. 23 3. Plaintiff’s trial brief, motions in limine, proposed jury voire dire, and proposed jury 24 instructions shall be filed no later than September 19, 2016. 25 4.
