(PC) VanDyke v. Sisto et al Doc. 44 1 2 3 4 5 6 7 8 9 10 11 12 13 BEFORE THE COURT is Plaintiff's Motion for Extension of Time for Follow Up 14 Discovery Request (Ct. Rec. 42). The discovery cut-off was August 24, 2010. Plaintiff 15 requests an additional 45 days, due to the delays in Defendants' responses to discovery 16 requests and the ongoing discovery disputes. Plaintiff's request is reasonable. However, an 17 additional 45 days would extend the deadline for discovery beyond the dispositive motion 18 deadline, currently September 24, 2010. Accordingly, the court extends the deadline for 19 discovery and dispositive motions to OCTOBER 15, 2010. 20 Only when the parties have a discovery dispute that they cannot resolve among 21 themselves should the parties even consider asking the court to intervene. The court does 22 not have enough time or resources to oversee all discovery, and therefore requires that the 23 parties present to it only their very specific disagreements. Parties are required to confer 24 prior to presenting their conflict to the court. Where, as here, one of the parties is a prisoner, 25 the court does not require in-person meetings and instead allows the prisoner and defense 26 counsel to meet and confer by telephone or exchange of letters.
