On January 23, 2013, plaintiff filed a request for reconsideration of the magistrate

17

judge’s order filed January 8, 2013, denying plaintiff’s request for the appointment of a medical

18

expert.1 Defendants have filed an opposition. Pursuant to E.D. Local Rule 303(f), a magistrate

19

judge’s orders shall be upheld unless “clearly erroneous or contrary to law.” Upon review of the

20

entire file, the court finds that it does not appear that the magistrate judge’s ruling was clearly

21

erroneous or contrary to law.

request for appointment of counsel.

Therefore, IT IS HEREBY ORDERED that, upon reconsideration, the order of the
