It did not re-set trial and the pre-trial CALIFORNIA DEPARTMENT OF CORRECTIONS AND REHABILITATION, ORDER UNITED STATES OF AMERICA, NO. CIV. S-09-1229 LKK/EFB conference, however, because the parties indicated that they were engaged in settlement negotiations and anticipated that the case would settle. On June 14, 2010, the parties submitted mid- litigation statements. These statements indicated that plaintiff expects to file a motion for partial summary judgment.
