By order filed September 27, 2010, plaintiff was granted twenty-eight days in which to pay the $350.00 filing fee and warned that failure to pay the filing fee in full would result in a recommendation that this action be dismissed. Twentyeight days have now passed, and plaintiff has failed to pay the filing fee or otherwise respond to the court's order. Accordingly, this action should be dismissed. IT IS HEREBY RECOMMENDED that this action be dismissed without prejudice. See Local Rule 110; Fed. R. Civ. P. 41(b). These findings and recommendations are submitted to the United States District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l).
