On August 7, 2009, the Magistrate Judge filed findings and recommendations herein which were served on the parties and which contained notice that the parties may file objections within a specified time. On August 24, 2009, the court issued an order adopting the Magistrate Judge's findings and recommendations. However, that order incorrectly stated that no objection had been filed. Defendant filed an objection on August 21, 2009, which was not entered on the docket until the same day the August 24 Order was filed.
