On July 1, 2010, Priyanka Khanna moved under Federal Rule of Civil Procedure 25(a)(1) to be substituted as a plaintiff in this case in the place of Shashi Khanna, who died on May 4, 2010, during the pendency of this action. (Docket No. 39.) Priyanka Khanna declares

that she is Shashi Khanna's natural daughter and successor in interest as defined in section 377.11 of the California Code of Civil Procedure and succeeds to her interest in this proceeding. 16.) (Khanna Decl. ¶ 15-
