The matter was referred to a United States Magistrate 14 Judge pursuant to 28 U.S.C. § 636(b)(1)(B) and Local Rule 302. 15 On December 7, 2011, the magistrate judge filed findings and recommendations 16 herein which were served on all parties and which contained notice to all parties that any 17 objections to the findings and recommendations were to be filed within twenty-one days. 18 Neither party has filed objections to the findings and recommendations. 19 The court has reviewed the file and finds defendants’ unopposed motion for 20 summary judgment to have merit. Accordingly, IT IS HEREBY ORDERED that defendant’s 21 motion for summary judgment be, and the same hereby is, GRANTED. 22 23 DATED: January 11, 2012 24 25 26 1
