OF 4 WHEEL DRIVE CLUBS, et al., 13 14 Defendant-Intervenors. 15 16 Whereas by order dated November 5, 2012, the Court stayed briefing on Plaintiffs’ petition for 17 costs and attorney fees until December 28, 2012 by which time the Parties are to advise the Court on the 18 status of the their settlement discussions. No. 130; 19 Whereas Plaintiffs and Federal Defendants have engaged in substantive good-faith discussions 20 attempting to negotiate a settlement of the issue of costs and attorney fees; 21 22 23 24 Whereas Plaintiffs and Federal Defendants desire more time to explore settlement of the cost and attorney fee issue; Whereas Defendant-Intervenors have not participated in the negotiations, and thus have not 25 formed a position but have been consulted regarding this stipulation and do not oppose any request that 26 the primary parties continue negotiations; 27 Accordingly, Plaintiffs and Federal Defendants stipulate and agree, and request that the Court 28 PLAINTIFFS’ AND FEDERAL DEFENDANTS’ STIPULATION AND [PROPOSED] ORDER REGARDING THE DEADLINE FOR MOTION FOR ATTORNEYS’ FEES AND COSTS 2 Case No. 2:09-cv-2523-LKK-JFM 1 enter an order staying for 60 days, until February 26, 2013, the deadline for Plaintiffs to file a motion for 2 attorneys’ fees, costs, and other expenses at which time the Parties will advise the Court on the status of 3 the their settlement discussions.
