Also, in the prior order, petitioner was directed, inter alia, either to submit the appropriate in forma pauperis affidavit or to pay the required $ 5.00 filing fee. See 28 U.S.C. §§ 1914(a); 1915(a). Court records indicate that, on October 20, 2009, petitioner paid the filing fee. Accordingly, IT IS ORDERED that: 1. The amended petition, filed on October 20, 2009 (docket # 9), supersedes the original petition to which respondent was initially ordered to respond; Petitioner is cautioned not to file any further amended petition absent an order from this ORDER No. CIV S-09-2703 GGH P court. 1 2 3 4 5 6 7 8 9 GGH:009 2.
