On April FARID ZADRAN, Plaintiff, Civ. No. S-09-2708 FCD/DAD MEMORANDUM AND ORDER UNITED STATES DISTRICT COURT EASTERN DISTRICT OF CALIFORNIA ----oo0oo---- 30, 2010, plaintiff filed a statement of non-opposition, 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 requesting that all claims against all defendants be dismissed without prejudice pursuant to Federal Rule of Civil Procedure 41(a) (providing that a party may dismiss an action without court order before the opposing party serves either an answer or a motion for summary judgment); see Swedberg v. Marotzke, 339 F.3d 1139 (9th Cir. 2003) (defendant's filing of a motion to dismiss, pursuant to FRCP 12(b), does not prevent the plaintiff from later filing a voluntary dismissal).
