MEMORANDUM AND ORDER signed by Judge Morrison C. England, Jr on 2/16/10 ORDERING that Defendants' Motion to Dismiss 7 is GRANTED with leave to amend.As a result of Plaintiff's counsel Sharon Lapin's ("Lapin") repeated failu re to comply with the Local Rule, Lapin is hereby ordered to show cause as to why sanctions should not now be imposed; Lapin is ordered to personally appear before this Court at 2:00 p.m. on Thursday, February 25, 2010, in Courtroom 7 for the hearing on the Order to Show Cause. Lapin shall have until Thursday, February 18, 2010 to file a written response as to why she should not be sanctioned for her continual disregard of the Rules of this Court. The Court reserves the right to vacate the hearing based upon the written response filed by Lapin. (Becknal, R)
