On April 28, 2010, the court directed respondent to file a response to the petition. He has not responded to the court's order. On July 19, 2010, petitioner filed a motion for a ruling on his habeas petition, noting respondent's failure to respond and reasoning that he is entitled to relief. However, the state's failure to respond does not entitle petitioner to a default judgment. Gordon v. Duran, 895 F.2d 610, 612 (9th Cir. 1990). IT IS THEREFORE ORDERED that: 1.
