ORDER 14 / 15 Plaintiff is a former state prisoner proceeding without counsel in an action brought under 16 17 42 U.S.C. § 1983. On May 21, 2013, the court recommended that this action be dismissed for 18 failure to prosecute after plaintiff failed to file a response to defendants’ motion to dismiss. 19 Dckt. No. 35. The next day, plaintiff’s “objections” to the motion to dismiss were filed. Dckt. 20 No. 36. The court construes plaintiff’s filing as an opposition to the motion to dismiss. 21 Accordingly, IT IS HEREBY ORDERED that: 22 1. The findings and recommendations (Dckt. No. 35) are vacated; and 23 2. Defendants’ reply, if any, shall be filed within seven days of the date this order is 24 served. 25 Dated: June 3, 2013. 26
